Fiscal Note
No appropriation is required to enter into this agreement. The property owner will be responsible for all costs related to the connection of her property to the City’s water and sanitary sewer facilities, which are adjacent to the subject property.

Body
WHEREAS Sections 8.C.1. and 12.C of the Town of Burke, Village of DeForest, City of Sun Prairie and City of Madison Cooperative Plan approved on May 4, 2007 pursuant to Wis. Stat. §66.0307 permit a property owner in the Town to request connection to City sewer and/or water services prior to the dissolution of the Town and final attachment of its remaining properties in 2036, provided the sewer and/or water services are reasonably available, the property to be served is in an Urban Service Area, the owner agrees to pay for extension of the sewer and/or water services over a five-year period with interest, and the owner agrees to attachment to City at the end of the five-year period; and,

WHEREAS, Diane M. Sturdevant, the Owner of real property located 934 on Eagle Crest Drive in the Town of Burke (hereinafter referred to as “the Property”), wishes to connect her future single-family residence to City of Madison sanitary sewer and water facilities currently located adjacent to the Property in Eagle Crest Drive; and,

WHEREAS, on September 13, 2010, the Owner submitted a petition to attach the Property to the City with an effective date of November 1, 2015 (Legislative File ID 19982) as provided for in said Cooperative Plan; and,

WHEREAS, the Property is located in the Central Urban Service Area, and due to the location of the sanitary sewer and water mains, service will not need to be extended to serve the Property; and,
