DRAFTER'S ANALYSIS:  The State of Wisconsin recodified former Wis. Stat. ch. 166 as new Wis. Stat. ch. 323, Emergency Management.  This ordinance updates the statutory references and adds the definition of disaster to be in compliance with state law.

The Common Council of the City of Madison do hereby ordain as follows:
1.      Subdivision (b) of Subsection (1) entitled "Policy and Purpose" of Section 3.20 entitled "Emergency Management" of the Madison General Ordinances is amended to read as follows:
"(b)      It is further declared to be the purpose of this ordinance and the policy of the City that all emergency management functions of the City shall be carried out pursuant to this ordinance and the emergency management plan developed hereunder, as part of a county-wide emergency management program to the maximum extent practicable. Existing services and resources of this City shall be used as needed. All of this shall be carried out within the framework of Wis. Stat. ch.Chapter 166 323 of the Wisconsin Statutes."
2.      New Subdivision (e) of Subsection (2) entitled "Definitions" of Section 3.20 entitled "Emergency Management" of the Madison General Ordinances is created to read as follows:
"(e)      "Disaster" means a severe or prolonged, natural or human-caused, occurrence that threatens or negatively impacts life, health, property, infrastructure, the environment, the security of this state or a portion of this state, or critical systems, including computer, telecommunications, or agricultural systems."
3.      Current Subdivisions (e) through (m) of Subdivision (2) entitled "Definitions" of Section 3.20 entitled "Emergency Management" of the Madison General Ordinances are renumbered to Subdivisions (f) through (n), respectively.
4.      Renumbered Subdivision (h) of Subdivision (2) entitled "Definitions" of Section 3.20 entitled "Emergency Management" of the Madison General Ordinances is amended to read as follows:
"(h)      "Emergency Management Coordinator" shall mean "Head of Emergency Management Services" as that term is used in Wis. Stat. ch.Chapter 166 323 of the Wisconsin Statutes."
5.      Subdivision (a) of Subsection (4) entitled "Powers and Duties of the Emergency Management Coordinator" of Section 3.20 entitled "Emergency Management" of the Madison General Ordinances is amended to read as follows:
"(a)      The Emergency Management Coordinator shall develop and promulgate emergency management plans consistent with state plans, direct the emergency management program and perform such other duties related to emergency management as are required by the Common Council.  The emergency management plan shall require the use of the incident command system and NIMS, as appropriate, by all emergency response agencies, including the local health department as defined in sec. 250.021(4), Wis. Stats. Wis. Stat. § 250.01(4), during a state of emergency declared by the Governor under sec. 166.03(1)(b)1., Wis. Stats. Wis. Stat. § 323.10, or by the Mayor or Common Council hereunder, or by the Common Council under Sec. 3.19 of the Madison General Ordinances or in any other multi-jurisdictional or multi-agency emergency response."
