Costs related to this agreement will be paid through the Annual Sidewalk Repair Rebate Program. This rebate program is funded by the Sidewalk Program Capital Budget Proejct (Engineering - Other Project 2).

Body
WHEREAS, on December 19, 2008, the co-developers, Board of Regents of the University of Wisconsin System and the Wisconsin Alumni Research Foundation of Madison, Wisconsin, had entered into a Maintenance Agreement with the City of Madison, and;
WHEREAS, the Developers have requested changes to the agreement that are mutually beneficial to the City and the Developers for the continued maintenance of a sidewalk easement adjacent to the development.
WHEREAS, The City of Madison has agreed to share in the costs for the required maintenance and shall pay for improvements in accordance with the City of Madison's Sidewalk Repair Rebate Program. The exact costs for future maintenance are not known at this time.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Mayor and City Clerk are hereby authorized and directed to execute Addendum No. 1 for Maintenance Agreement for portions of the public right of way at 1301 University Avenue / 330 North Orchard Street: Wisconsin Institutes for Discovery / Morgridge Institute for Research (WID/MIR), with Board of Regents of the University of Wisconsin System and the Wisconsin Alumni Research Foundation to allow for the continued maintenance of sidewalk adjacent to the development at 1301 University Avenue and 330 North Orchard Street.
2. That the City of Madison shall reimburse the developers in accordance with the City of Madison's Sidewalk Repair Rebate Program.
