Approving Addendum No. 1 to the Contract for Subdivision Improvements for Metrotech, Contract No. 1889.   (3rd AD)
Body
WHEREAS, on January 2, 2003, the developer, Metro-tech, LLC of Madison, Wisconsin, had entered into a Contract for Subdivision Improvements with the City of Madison, and;
 
WHEREAS, the Developer required assistance by the City of Madison to acquire right of way on Hoppman Drive and Milwaukee Street to complete the improvements as required under the Subdivision Contract, and;
 
WHEREAS, The City of Madison assisted the Developer in the acquisition of the lands necessary to complete the roadway improvements, in addition to providing engineering, testing and inspection services for this project at the sole cost of the Developer, and;
WHEREAS, the Developer has requested that the City create an assessment district to allocate the City costs associate with this project to the lots that are controlled by the Developer.
 
NOW, THEREFORE, BE IT RESOLVED:
 
1.      That the Mayor and City Clerk are hereby authorized and directed to execute Addendum No. 1 for Metrotech, Contract No. 1889,  with Metro-Tech, LLC  to allow for assessment of charges for services provided by the City of Madison for the Metrotech Plat.
 
2.             That the City of Madison will create an assessment district entitled Metrotech Plat Assessment District, 2010 that will assess all costs associated with the City services provided to the Developer.
 
3.      That the Developer shall execute a waiver of hearing and notice for the assessment district.
 
4.      That the Developer has completed the construction of the public improvements in accordance with the terms of the Contract for Subdivision Improvements.
