Approving a maintenance agreement for Half Moon Court for privately maintained improvements within the public right of way. (16th AD)
Body
WHEREAS, the property owner, Meadowlands Land, LLC has requested to have a landscaping island installed within O.L. 14 located on Half Moon Court as part of the Meadowlands Subdivision improvements for Phase 2, Engineering Project Number 53B1967, Contract No. 1967, and,
WHEREAS, Meadowlands Land, LLC was required to enter into a maintenance agreement with the City per the Subdivision Contract No. 1967, for said improvements of way to insure the public's long term use and function of the landscaping within the island as requested, and;
WHEREAS, the Meadowlands Land, LLC has directed The Homeowners Association for The Meadowlands, Inc. to enter into the maintenance agreement with the City of Madison for the perpetual maintenance of the landscape island, namely O.L. 14 of The Meadowlands Subdivision, on Half Moon Court.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Mayor and City Clerk are hereby authorized and directed to execute an agreement between The City of Madison and The Homeowners Association for The Meadowlands, Inc. for the maintenance of O.L. 14 located on Half Moon Court.
