Approving Addendum No. 1 to the Subdivision Contract for Meadowlands - Phase I, Contract No. 1966.  (16^th AD)

Body

WHEREAS, on June 7, 2004, the developer, Meadowlands Land LLC., had entered into a Subdivision Contract with the City of Madison and,

WHEREAS, the Contract did not provide for reimbursement of street infrastructure costs the Developer constructed adjacent to City owned lands.

NOW, THEREFORE, BE IT RESOLVED:

1.      That the Mayor and City Clerk are hereby authorized and directed to execute Addendum No. 1  or The Meadowlands Phase I, Contract No. 1966   with Meadowlands Land LLC.,  to provide reimbursement for streets infrastructure constructed adjacent to City owned lands.

2.      That the developer is authorized to construct the public improvements in accordance with the terms of the Subdivision Contract at the sole cost of the developer, except as follows:  Reimbursement not to exceed the statutory limit for the cost of street improvements that benefit the City and abut lands owned by the City, in accordance with Section 16.23(9)(d)(6)(d).

Est. cost not to exceed $25,000 (statutory limit).  Funds available in Acct. No. CS53-58250-810354-53B1966.
