In February 2004, the Common Council adopted ORD 13501, which created Section 28.04 (25) of the Zoning Ordinance to provide for inclusionary dwelling units in new residential developments containing ten or more dwelling units. The policy, which was commonly referred to as Inclusionary Zoning, was intended to further the availability of a full range of housing opportunities for families of all income levels throughout the City by setting aside dwelling units in new developments for sale or lease by families with incomes less than the area median income. The ordinance went into effect on February 16, 2004 and underwent substantial revisions that were adopted by the Common Council in July 2006 (ORD 06-00089).

As part of the adoption of the original Inclusionary Zoning ordinance, the Council included a requirement that a separate policy and procedure document be established to assist in the implementation of the ordinance. The Inclusionary Zoning Program Policies and Procedures Document includes policies governing the administration of the Inclusionary Zoning ordinance, information on the effective project approval policies, copies of effective ordinances, as well as the work of the Inclusionary Zoning Advisory Oversight Committee, which was established following adoption of the Inclusionary Zoning ordinance in 2004 to help oversee implementation of the program.

At its last meeting, the Inclusionary Zoning Advisory Oversight Committee approved changes to the Inclusionary Zoning Policies and Procedures Document and recommended taking the revised document to the Plan Commission for their approval.
