As part of the approval on May 5, 2009 of ORD-09-00078, which expanded the boundaries of Urban Design District 1, the Common Council at the recommendation of the Plan Commission and Urban Design Commission revised the boundary of the expanded district to exclude portions of the Certco, Inc. property located at 4802 Femrite Drive and 2730 Daniels Street. The Plan Commission recommended that approval of the revised urban design district boundary be subject to Certco, Inc. executing covenants and restrictions approved by Planning Division staff and the district alder, which restricted the future use of the Certco  property as part of the approval of the Certified Survey Map needed to divide the subject property from the portion that would be in the amended urban design district from the portion to be excluded per the agreement.

 

The Plan Commission approved the two-lot Certco, Inc. Certified Survey Map on June 15, 2009 with a condition that the applicant submit covenants and restrictions for approval by the Plan Commission prior to final approval and recording of the Certified Survey Map. The CSM was approved by the Common Council with the same condition on July 7, 2009.

 

Certco is requesting approval of the attached Declaration of Covenants and Restrictions so that they may receive final staff approval of their Certified Survey Map prior to recording.
