Determining a Public Purpose and Necessity and approving a Relocation Order for the acquisition of utility company interests required for the relocation and construction of Pleasant View Road from Valley View Road to 1000 feet North of Mineral Point Road, located in that part of the Northeast ¼ of the Northwest ¼, of Section 34, Town 7 North, Range 8 East, Town of Middleton, and part of the Northwest ¼ of the Northeast ¼ of Section 34, and part of the Northwest ¼ and the Southwest ¼ of Section 27, all in Town 7 North, Range 8 East, City of Madison, Dane County, Wisconsin. Including necessary utility company release of rights of interests contained within proposed right of way dedications by the conditionally approved University Research Park - Pioneer proposed Subdivision Plat by the UW Regents (9th AD) and;
 
Body
WHEREAS, the City of Madison on June 12, 1973 adopted Resolution No. 24,966, File Number 5035-6, adding Official Map Sections 22, 27 and 34, Town 7 North, Range 8 East; and
 
WHEREAS, the City of Madison Official Maps, added by said resolution, contained various proposed streets and parkways, including proposed Pleasant View Road from existing Valley View Road north to Mineral Point Road; and
 
WHEREAS, the current adopted City of Madison Pioneer Neighborhood Development Plan includes relocated Pleasant View Road; and
 
WHEREAS, the City of Madison has reviewed and conditionally approved the preliminary plat of "University Research Park-Pioneer" submitted by the University of Wisconsin Board of Regents for lands included in the said Pioneer Neighborhood Development Plan; and
 
WHEREAS, said conditionally approved preliminary plat of "University Research Park-Pioneer" attached hereto and made part of this resolution; and
 
WHEREAS, as a result of recommended Pleasant View Road alignment changes by the Common Council, the proposed University of Wisconsin Board of Regents Subdivision Plat "University Research Park-Pioneer" has been revised to facilitate the proposed dedications for Pleasant View Road within the boundaries of the Subdivision Plat; and
 
WHEREAS, the City of Madison Engineering Division has created the following City Project Numbers associated with the various Pleasant View Road / Mineral Point Road construction portions:
 
53W0390 - CTH M - Valley View Road - Pleasant View Road Intersection
53W0391 - Mineral Point Road (CTH S) and Junction Road (CTH M) Intersection
 
WHEREAS, the City of Madison has initiated the acquisition of required land interests and must also negotiate both permanent and temporary conveyance of rights from the utility companies known to have existing facilities contained within the right-of-way acquisition areas; and
 
WHEREAS, the permanent and temporary conveyance of rights from the utility companies known to have existing facilities contained within the right-of-way acquisition areas are identified on the attached Relocation Order and made part of this resolution; and
 
WHEREAS, all required funding for the utility interest acquisitions are available in Account No. CS53-58110-810543-00-53W0391; and
 
NOW COMES THE CITY OF MADISON, Dane County, Wisconsin, by its City Council and for its Relocation Order hereby resolves as follows:
 
1.      That by adoption of this Resolution as a Relocation Order in accordance with Section 32.05(1) and 62.22, Wisconsin Statutes, inclusive of all associated maps and legal descriptions attached hereto and made part of this adopted  Relocation;
 
2.      That this Resolution is a Relocation Order in accordance with Section 32.05(1) and 62.22, Wisconsin Statutes for the purpose of the within described public acquisition project and that this acquisition is determined to be necessary in accordance with Section 32.07(2), Wisconsin Statutes, and that the acquisition shall allow for the construction of public improvements related to:
 
      53W0390 - CTH M - Valley View Road - Pleasant View Road Intersection
      53W0391 - Mineral Point Road (CTH S) and Junction Road (CTH M) Intersection
 
3.      That the City of Madison Office of Real Estate Services of the Economic Development Division and the City Attorney are hereby authorized to proceed by negotiation or condemnation under authority of Section 32 and 62.22 of the Wisconsin Statutes to acquire the real estate interests shown on said Relocation Order, and the Office of Real Estate Services is further authorized to obtain title reports, appraisals, survey information, environmental site assessment reports, and any other essential material or reports as may be necessary to perform due diligence in accomplishing the acquisition;
 
4.      That the City of Madison Office of Real Estate Services of the Economic Development Division is hereby authorized to execute the jurisdictional offer, lis pendens, and award of the compensation if condemnation proceedings under Section 32 of the Wisconsin Statutes are necessary;
 
5.      That the Mayor and City Clerk are authorized to sign all necessary documents necessary to accomplish the acquisition;
 
6.      That the City Clerk shall file this Relocation Order with the Dane County Clerk in accordance with Section 32 of the Wisconsin Statutes;
