Approving Addendum No. 1 to the Subdivision Contract for Eastlawn - Phase I, Contract No. 2210.   (3rd AD)

Body

WHEREAS, on July 6, 20 09, the developer, Homburg Equipment, Inc., had signed a Subdivision Contract No.  2210 with the City of Madison and,

WHEREAS, Upon the Developer's request, the assumption of liability for the completion of Contract 2210 shall be transferred to Homburg Contractors, Inc., and,

WHEREAS, Addendum No. 1 shall require an assignment and assumption of Subdivision Contract obligations.

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to execute Addendum No. 1 for Eastlawn - Phase I   to allow for the Developer to transfer liability of Subdivision Contract No. 2210 from Homburg Equipment, Inc. to Homburg Contractors, Inc.
