Title
Authorizing the Common Council to accept ownership from Leopold Neighborhood Association of two neighborhood entrance signs with landscaping to be located in the Cannonball Bike Path corridor at the West Beltline Highway frontage road and at the Post Road intersections.
Body
WHEREAS, the Leopold Neighborhood Association wishes to install and maintain two neighborhood entrance signs and landscaping to be located within the Cannonball Bike Path corridor at the West Beltline Highway frontage road and at the Post Road intersections, as shown on Exhibit A; and
 
WHEREAS, the City will be constructing the Cannonball bike path infrastructure in the near future, so the signs must be installed on temporary footings with minimal landscaping which can be moved during the construction period; and      
 
WHEREAS, the City Engineering and Traffic Engineering Divisions have conditionally approved of the placement of the neighborhood entrance signs and landscaping; and
 
WHEREAS, the Privilege in Streets Committee has reviewed this request and approved it with conditions; and
 
WHEREAS, the Leopold Neighborhood Association will transfer ownership of the neighborhood entrance signs and landscaping to the City after they have been installed, in exchange for the ongoing maintenance of the signs and landscaping by the Leopold Neighborhood Association.
 
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Madison accepts ownership, from the Leopold Neighborhood Association of two neighborhood entrance signs and landscaping to be located within the Cannonball Bike Path corridor at the West Beltline Highway frontage road and at the Post Road intersections, as shown on the attached Exhibit A; subject to the following conditions:
 
1.      The Leopold Neighborhood Association shall be responsible for all costs of installation and maintenance of the sign and landscaping.
 
 
2.      The Leopold Neighborhood Association shall locate the signs within specific areas, as approved by the City Engineering and Transportation Divisions.
 
3.      The Leopold Neighborhood Association shall install signs on temporary footings during the construction period for the Cannonball Bike Path corridor.  The Leopold Neighborhood Association shall be responsible for moving the signs and landscaping during the construction project.
 
4.      The Leopold Neighborhood Association is responsible for locating all underground utility services in the construction areas, i.e., shall contact Diggers Hotline prior to any excavation or construction activities.
 
5.      The Leopold Neighborhood Association shall comply with all Madison General Ordinances regarding the construction and installation of the signs within public right-of-way, including any and all applicable City of Madison permits for excavation and installation, including a City Engineering Excavation Permit, if applicable.
 
6.      The Leopold Neighborhood Association shall agree that the City shall not be held responsible for any damage to the signs and landscaping that may be caused by the City, its employees, contractors, or others.
 
7.      The City may remove the signs and landscaping if not properly maintained, by giving the Leopold Neighborhood Association sixty (60) days written notice prior to removal.  The Leopold Neighborhood Association is responsible for any reasonable costs associated with such removal.
 
The City may remove the signs and landscaping if the area occupied by sign is required for transportation or other public purposes, by giving the Leopold Neighborhood Association sixty (60) days written notice prior to removal.  Transportation purposes include, without limitation because of enumeration, public alleys, streets, highways, bike paths, sidewalks, and facilities for the development, improvement and use of public mass transportation systems.
