Fiscal Note
The YMCA will pay the City $6,431.45 for the use of the premises in 2009. Payments are to be made in installments on July15 and August 15 of 2009. No appropriation is required.

To authorize the Mayor and City Clerk to enter into a Use Agreement with the YMCA of Dane County, Inc. for the YMCA's non-exclusive use of Elver Park for a summer day camp in 2009 with the possibility of two,1-year renewals.
Body
WHEREAS, the YMCA of Dane County, Inc. ("YMCA"), has been successfully providing a weekday, daytime summer camp for YMCA participants at Elver Park since 2002 through Use Agreements with the City of Madison ("CITY"), which expired on August 26, 2008; and
WHEREAS, the YMCA wishes to continue offering a daytime summer camp at Elver Park for the 2009 summer season; and
WHEREAS, the Parks Division has ensured that Madison residents will still have access to Elver Park facilities including a shelter, restrooms, basketball courts and baseball diamonds during the summer of 2009; and
WHEREAS, the YMCA will pay all maintenance costs and permitting fees as well as provide adequate general liability insurance and a five thousand dollar ($5,000) damage deposit for their non-exclusive use of the park.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk be authorized to enter into a Use Agreement on behalf of the City with the YMCA for the YMCA's non-exclusive use of Elver Park facilities for a summer 2009 weekday camp with the possibility of a two 1-year renewals according to terms and conditions mutually agreed upon by the parties.
