PREAMBLE
 
The Madison Metropolitan Sewerage District (MMSD) will be installing 9,250 feet of sanitary sewer ranging in size from 48 inches to 64 inches in diameter in a corridor between Milwaukee Street and Lien Road.  The new sanitary sewer will relieve or replace an existing reinforced concrete sewer that was installed in 1964 and is beginning to deteriorate due to corrosion.  
 
Construction of the new sewer is expected to begin in the fall of 2009 and continue throughout 2010.  Work will be performed in private lands, public right-of-way, State of Wisconsin (WDOT) property, railroad property, and other City of Madison lands.
 
Specific locations of the work are shown on the attached map and described as follows:
  • Regas Road, from MMSD Pump Station No. 10 (near the East Post Office) to Blettner Blvd.
  • Across private lands to the Highway 30 right-of-way.
  • Crossing Highway 30 (via a tunnel), west of Highway 51.
  • Along the Commercial Avenue frontage road, northwest of the Highway 51/30 interchange.
  • Crossing Highway 51 (via a tunnel), north of Highway 30.
  • Through the westbound lanes of Nakoosa Trail, to near Walsh Road.
  • Across private lands to Sycamore Avenue.
  • Across Sycamore Avenue and the railroad tracks (via a tunnel).
  • Across private lands to Lien Road.
 
This new sanitary sewer will be primarily constructed in an excavated trench.  The new sewer will be installed in tunnels at three separate locations to cross beneath Highway 30, Highway 51, and Sycamore Avenue.  Pedestrian, bicycle, and motor vehicle traffic will be disrupted at various times and at various locations during the project.  During pipe installation on Regas Road, one-half of Regas Road will be closed, but will remain open to through traffic at all times.  One-half of the Commercial Avenue frontage road will also be closed during construction in that area.  The westbound lanes of Nakoosa Trail will be closed and traffic will be diverted to the eastbound lanes during pipe installation in that area.  The Marshview Bike Path will be closed from Mayfair Avenue to Regas Road during pipe installation between Regas Road and Highway 30.  
 
Portions of the work will need to be performed during nighttime hours and on weekends.  Noise will be limited as much as possible during these times.  Trees will also be removed as part of the project.  Most trees to be removed are on private lands located between Nakoosa Trail and Lien Road.  These will be replaced per landowner request.
 
Madison General Ordinance section 24.08(3) provides the Common Council the ability to allow construction activities outside the hours of 7:00 AM to 7:00 PM with the passage of a resolution and a hearing before the Board of Public Works.  The construction of this project cannot be built between the hours of 7:00 AM and 7:00 PM because:
 
1.      The work will disrupt traffic and limit access to businesses during regular business hours, which will have negative economic impacts.
 
2.      Flow rates for the existing sanitary sewer are much lower during night hours, which will significantly reduce the difficulty associated with connection to the existing sewer.
 
The proposed activities beyond the hours of 7:00 AM and 7:00 PM are as follows:
 
1.      General construction activities adjacent to businesses that would otherwise negatively impact access.  The intent is to provide the Contractor with the ability to work after businesses close or the ability to work extended hours to expedite the completion of the work.
 
2.      Sanitary, water, storm sewer or private utility tie-ins and construction near or under live traffic lanes or near or under drives to access businesses.  The Contractor shall make ever effort to limit this construction to the hours of 7:00 AM to 10:00 PM but shall be allowed to work beyond those hours if determined necessary by the City Engineer or designee.
 
3.      Certain areas of this project will utilize tunneling in order to limit the impact to traffic, which may require that the contractor extend their hours from 7:00 PM to 7:00 AM with every effort being made to not work during the hours of 10:00 PM and 7:00 AM.  
 
4.      Working beyond the hours of 7:00 AM and 7:00 PM shall be limited to fifteen nights total where night /weekend work will be required, where some of the nights may be consecutive.  Times and locations shall be approved by the City Engineer or his designee.
 
 
NOW, THEREFORE, BE IT RESOLVED:
 
1.      That the plans for the public improvements necessary to serve the project are hereby approved with all work being completed under a Permit to Excavate in the Right of Way.
 
2.      That construction work, with associated noise impacts, between the hours of 7:00 PM and 7:00 AM within the project limits are limited to those activities identified in this resolution and are limited to the hours specified are hereby approved in accordance with section 24.08(3) of the Madison General Ordinance.
 
3.      The approval of that construction work shall be limited to 15 nights total, as provided in this resolution and shall expire on June 1, 2010.
 
4.      That the Mayor and City Clerk are hereby authorized to sign and grant easements or right-of-way release or procurement documents, maintenance agreements or encroachment agreements, as necessary and grant or accept dedication of lands and/or easements from/to the Developer/Owner for public improvements located outside of existing public fee title or easement right-of-ways.
 
5.      That MMSD is authorized to construct the public improvements in accordance with the terms of the Permit to Excavate in the Right of Way at the sole cost to MMSD.
