Approving Addendum No. 1 to the Contract for Subdivision Improvements for Northport Commons, Contract No. 1982.   (18th AD)
Body
WHEREAS, on July 1, 2004, the developer, C-CAP, LLC of Waukesha, Wisconsin, had entered into a Contract for Subdivision Improvements with the City of Madison, and;
 
WHEREAS, the contract obligation for this project had been changed from C-CAP, LLC to Habitat for Humanity of Dane County, Inc., and;
 
WHEREAS, Habitat for Humanity of Dane County, Inc. has submitted a replat application for this development entitled The Park Homes of Northport Commons, which has been conditionally approved by the Plan Commission, and;
 
WHEREAS, the Developer is required to install public water main and other incidental infrastructure improvements to serve the reconfigured lots as part of the replatting.
 
NOW, THEREFORE, BE IT RESOLVED:
 
1.      That the Mayor and City Clerk are hereby authorized and directed to execute Addendum No. 1 for Northport Commons, Contract No. 1982,  with Habitat for Humanity of Dane County, Inc.  to allow for the installation of public improvements to serve the Park Homes at Northport Common Plat.
 
2.      That the plans and specifications for the public improvements for Addendum No. 1 as required to serve this the subdivision are hereby approved.
 
3.      That the developer is authorized to construct the public improvements in accordance with the terms of the Contract for Subdivision Improvements, Addendum No. 1 at the sole cost of the developer.
 
4.      That the Mayor and City Clerk are hereby authorized to sign easements or right-of-way release or procurement documents, maintenance agreements or encroachment agreements, as necessary and accept dedication of lands and/or easements from the Developer/Owner for public improvements located outside of existing public fee title or easement right-of-ways.
