Approving a maintenance agreement for privately maintained improvements within the public right-of-way (within Portage Road and East Park Boulevard as part of the American Center Plat - Hanson Road Addition, Contract No. 2047). (17th AD)
Body
WHEREAS, the property owner, The American Center Owner's Association, Inc. has requested to have landscaping installed within Portage Road and East Park Boulevard as part of the American Center Plat - Hanson Addition, Engineering Project No. 53B2047, Contract No. 2047, and,
WHEREAS, the American Center Owner's Association, Inc. was required to enter into a maintenance agreement with the City per the Subdivision Contract No. 2047 for said improvements of way to insure the public's long term use and function of the landscaping as requested, and;
NOW, THEREFORE, BE IT RESOLVED:
1. That the Mayor and City Clerk are hereby authorized and directed to execute an agreement between The City of Madison and The American Center Owner's Association, Inc. for the maintenance of portions of the Portage Road and East Park Boulevard public right-of-way.
