Approving plans and specifications for public improvements necessary for the Subdivision known as Brown Business Park and authorizing construction to be undertaken by the Developer, Private Contract No. 6362.
Body
WHEREAS, the developer, SMR Real Estate, LLC, has received the City of Fitchburg's approval to create the subdivision known as Brown Business Park, located in the Rolfsmeyer area water district; and
 
WHEREAS, extending Fitchburg water utility services to the Rolfsmeyer area water district would be difficult and costly due to its isolation; and
 
WHEREAS, the City of Fitchburg and the City of Madison entered into a Revenue Sharing Agreement for the Rolfsmeyer area water district effective June 19, 2008;
 
NOW, THEREFORE, BE IT RESOLVED:
 
1.      That the Mayor and City Clerk are hereby authorized and directed to execute a Contract for the       Construction of Public Improvements that will be accepted by the City of Madison for Brown       Business Park, with SMR Real Estate, LLC.
 
2.      That the plans and specifications for the public water improvements necessary to serve the       subdivision are hereby approved.
 
3.      That the developer is authorized to construct the public water improvements in accordance with       the terms of the Contract for the Construction of Public Improvements that will be accepted by       the City of Madison at the sole cost to the developer.
