Approving temporary construction work with associated noise impacts between the hours of 7:00 PM and 7:00 AM on the South Madison Beltline between Whitney Way and Verona Road. (1st, 10th, 19th & 20th ADs)

PREAMBLE
The Wisconsin Department of Transportation (WisDOT) has a project to improve the South Madison Beltline from Whitney Way to Verona Road. The planned improvements include construction of concrete barrier wall, storm sewer, and asphalt pavement in the median, as well as replacing pavement marking on all lanes and ramps. Construction is planned to take place during the 2009 construction season.
The construction of this project cannot take place during the normal working hours of 7:00 AM to 7:00 PM because of the high traffic volume on the roadway. Night work will be required to avoid traffic backups and excessive disruption to normal travel patterns.
The proposed activities that will occur during the hours of 7:00 PM to 7:00 AM are general construction operations including sawing asphalt; removing asphalt, base course and earth; placing fill, base course and asphalt; pouring new concrete barrier, installing new storm sewer pipes and inlets, pipe boring and jacking, modifying Sign Structure S-13-176, and installing new pavement markings.
Construction activities generally exceed the noise limits imposed by the Madison General Ordinances and temporary construction activity between the hours of 7:00 AM to 7:00 PM is allowed to exceed the noise limits imposed by the Madison General Ordinances. Madison General Ordinance section 24.08(3) provides the Common Council the ability to allow construction activities, with associated noise impacts, outside of the hours of 7:00 AM to 7:00 PM with the passage of a resolution.
NOW THEREFORE BE IT RESOLVED, that construction work, with associated noise impacts, between the hours of 7:00 PM and 7:00 AM on the South Madison Beltline are hereby approved in accordance with section 24.08(3) of the Madison...
