Accepting a 15-foot wide Public Sanitary Sewer Easement from Edyie Walther across property located at 5104 Spring Court.
Body
WHEREAS, in accordance with a provision for approval for the Conditional use Application to adjust the roof line and update the exterior appearance of the dwelling at 5104 Spring Court, the Owner is required to grant a 15-foot wide easement, at no cost to the City, for the existing sanitary sewer; and
 
WHEREAS, the owner has agreed to provide such easement to the City, and
 
WHEREAS, the City Engineering Division staff have reviewed and recommended acceptance of the easement.
 
NOW, THEREFORE, BE IT RESOLVED, that the City of Madison is hereby authorized to accept from the Owner, Edyie Walther, at no cost to the city of Madison, a fifteen-foot wide Public sanitary Sewer easement across lands described as follows:
 
Being a 15' wide Public Sanitary Sewer Easement lying in part of Lot 36, Block One, Spring Harbor, the Centerline of said easement more fully  described as follows:
 
Commencing at the southeasterly corner of said Lot 36;
Thence N30°32'00"E, 57.66 feet along the Easterly line of said Lot 36, to the Point of Beginning of this description;
Thence N70°23'16"W, 44.25 feet along the centerline of said easement and an existing sanitary sewer main to the Westerly line of said Lot 36 and the Point of Termination of this description.
 
Said easement to include all lands lying 7.5 feet Northerly and 7.5 feet Southerly normal and parallel to the above described centerline. The Northerly and Southerly lines of said easement shall extend and contract to terminate on the Easterly and Westerly lines of said Lot 36 to ensure continuity of said easement.
