Authorizing the execution of an Underground Utility Easement to Charter Communications across a portion of Secret Places Park located at 6001 Sledding Parkway.
Body
WHEREAS, Charter Communications ("Charter") is extending its underground fiber telecommunications system at Secret Places at Siggelkow Preserve, along and adjacent to Secret Places Park, in order to serve new development in the neighborhood called The Commons at Secret Places; and
 
WHEREAS, as part of the extension, Charter has requested a ten (10) foot wide underground fiber telecommunication line easement ("Easement") across a portion of Secret Places Park; and
 
WHEREAS, the City Parks Division has reviewed and approve of the Easement.
 
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Underground Utility Easement with Charter Communications for the Easement described as follows:
 
A strip of land, ten (10) feet in width, located in part of the Outlot 5, Secret Places at Siggelkow Preserve, in the NW¼ of Section 35, Town 7 North, Range 10 East, City of Madison, Dane County, Wisconsin, said easement strip being more particularly described as follows:
 
Being a ten (10) foot wide, perpendicular measure, strip of land located along a portion of the Easterly boundary line of said Outlot 5, lying adjacent to and westerly of Lot 125, Secret Place at Siggelkow Preserve; the Northerly terminus being the point of intersection with the Westerly prolongation of the North line of Said Lot 125, and the Southerly terminus being the point of intersection with the Northerly boundary of a public utility easement located ten (10) feet, more or less, Northerly of and parallel with the right-of-way line of Canyon Parkway.
 
The area of the Easement is depicted on attached Exhibit A.
