Approving a maintenance agreement for privately maintained improvements within the public right of way (S. Brooks Street Right of Way on S. Brooks Street at Mound Street to 200 Ft North). (13th AD)
Body
WHEREAS, the property owner, Meriter Hospital, has requested to make specific improvements within the terrace of S. Brooks Street Right of Way on S. Brooks Street at Mound Street to 200 Ft North, in conjunction with the infrastructure improvements and upgrades to their facilities, and;
WHEREAS, Meriter Hospital has received approval for a Minor Alteration to a Conditional Use for the installation of the site improvements, and;
WHEREAS, prior to authorizing Meriter Hospital to make improvements to the S. Brooks Street right of way, the City is requiring execution of a maintenance agreement for said improvements of way to insure the public's long term use and functions.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Mayor and City Clerk are hereby authorized and directed to execute an agreement between The City of Madison and Meriter Hospital for the Maintenance of portions of the public right of way on S. Brooks Street at Mound Street to 200 Ft North.
