Title: Amending Section 3.53(6)(e) and creating Section 3.54(10)(c) of the Madison General Ordinances to clarify the purposes of a provisional appointment and to allow persons in CG 18 or 44 to receive the higher salary of a position they might fill on a temporary basis.

Amending Section 3.53(6)(e) and creating Section 3.54(10)(c) of the Madison General Ordinances to clarify the purposes of a provisional appointment and to allow persons in CG 18 or 44 to receive the higher salary of a position they might fill on a temporary basis.

DRAFTER’S ANALYSIS: In some instances, persons in Compensation Groups 18 or 44 are asked to temporarily fill a position with a higher salary, but the ordinances do not now allow those persons to receive that higher salary on a temporary basis. This amendment allows such a temporary higher salary. It also clarifies the authority of the HR Director to make provisional appointments.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subdivision (e) entitled “Provisional Appointment” of Subsection (6) entitled “Types of Appointments” of Section 3.53 entitled “Civil Service System” of the Madison General Ordinances is amended to read as follows:
“(e) Provisional Appointment: An appointment to a position for which there is no eligible list. The Human Resources Director may approve provisional appointments on a limited basis while a position is being studied or while the Human Resources Department is actively working to fill a position on a permanent basis. Provisional appointments in excess of six months shall require council approval.”
2. Subdivision (c) of Subsection (10) entitled “Positions Filled in Temporary or Acting Capacity” of Section 3.54 entitled “Compensation Plan” of the Madison General Ordinances is created to read as follows:
“(c) Members of Compensation Group 18 and 44 filling temporarily, or in an acting capacity, the full duties and responsibilities of a position within a higher salary range in Compensation Group 18 or 44 shall be entitled, while filling such position, to...
