Authorizing the Mayor and City Clerk to execute and convey to the Wisconsin Department of Transportation Division of Transportation Districts a Temporary Limited Easement, within existing City of Madison owned Public Storm Water Detention lands, necessary for the construction of improvements identified in Middleton-Madison Mineral Point Road Interchange USH 12 (West Beltline Highway) State Project No. 5300-06-72.

WHEREAS, the State of Wisconsin Department of Transportation (WDOT) has scheduled for 2008 a Plan of Proposed Improvement Middleton-Madison Mineral Point Road Interchange USH 12 (West Beltline Highway) State Project No. 5300-06-72, and;
WHEREAS, the approved plan requires the Project Contractor to perform grading, excavation, seeding and placement of riprap on a portion of City of Madison owned lands adjacent to, and West of, the West Beltline Highway Eastbound Off-Ramp for Mineral Point Road, and;
WHEREAS, the City of Madison owned property is Outlot 2, Junction Ridge Plat, 8102 Mineral Point Road, 0708-224-0202-3, and;
WHEREAS, the WDOT has requested the City of Madison execute a Temporary Easement Agreement, attached and made part of this Resolution, to perform this necessary work over part of said City property, and;
WHEREAS, the City of Madison Engineering Division has established City of Madison Project No. 53W0660 - USH 12, Old Sauk Rd and Mineral Point Rd Interchanges relative to this WDOT project, and;
WHEREAS, the City of Madison Engineering Division and Board of Public Works recommends that the Mayor and City Clerk execute this Temporary Easement Agreement between the City of Madison and WDOT, without compensation, to allow this related work within the City of Madison property, per the plan, of which the appropriate plan pages are attached and made part of this resolution.
