AMENDED SUBSTITUTE - Awarding Public Works Contract No. 6105, Sachs Street Reconstruction & N. Marquette Street Sanitary Replacement.

BE IT RESOLVED, that Contract No. 6105 be awarded to Mandt Sandfill Trust, conditioned upon Mandt Sandfill Trust providing, on or before March 12, 2008, evidence that it meets Best Value Contracting requirements and further conditioned upon Mandt Sandfill Trust providing information on its legal status;
BE IT FURTHER RESOLVED, that in the event Mandt Sandfill Trust is unable to meet the above conditions, on or before March 12, 2008, that its bid is rejected as non-qualified, and that Contract No. 6105 be awarded to R.G. Huston; and
BE IT FURTHER RESOLVED, that this award is conditioned upon the that the following low bids for miscellaneous improvements be accepted and that the Mayor and City Clerk be and are hereby authorized and directed to enter into a contract with the low bidders contained herein, subject to the Contractor's compliance with Section 39.02 of the Madison General Ordinances concerning compliance with the Affirmative Action provisions and subject to the Contractors compliance with Section 33.07 of the Madison General Ordinances regarding Best Value Contracting:
BE IT FURTHER RESOLVED, that Mandt Sandfill Trust having failed to meet the conditions set out above, the contract is awarded to R.G. Huston Company, Inc.; and
BE IT FURTHER RESOLVED, that the City will execute a change order to Contract 6015 extending the interim and final completion dates for the contract to May 15 and June 23 respectively and will execute a change order to Contract 6069 extending the completion date to July 6, 2008.
BE IT FURTHER RESOLVED, that the funds be encumbered to cover the cost of the projects contained herein.
