It is anticipated that the changes will result in an increase in General Fund revenues of an estimated $70,000 annually.

SUBSTITUTE - Creating new Section 12.1335(4)(d), renumbering current Section 12.1335(4)(d) to Section 12.1335(4)(e), creating Section 12.1335(6), amending Section 12.1339, amending Section 12.141(2), creating new Section 12.141(3), renumbering current Sections 12.141(3)-(9) to Sections 12.141(4)-(10), and amending Section 1.08(3)(a) of the Madison General Ordinances to further deter snow parking violations and more efficiently allow for cleaning of the streets.
Body
DRAFTER'S ANALYSIS:  The amendments and modifications are being introduced to further deter parking violations during the snow season and to provide for more efficient means to clean and clear the streets.  A copy of Sec. 12.1335, as amended by this ordinance, is included in the Legistar attachments.  This ordinance does the following:
a.      Alternate side parking violations will remain at $20 forfeiture and the alternate side parking violation during a declared snow emergency will be increased to $60 for all areas of the city including the snow emergency zone.
b.            An additional subsection is created in Sec. 12.1335 which provides notice of potential towing and towing fees pursuant to Sec. 12.1331 for parking violations of alternate side parking or snow emergency parking.
c.            A new Subsection (6) of Sec. 12.1335 is created to provide for alternate side parking violation outside of the snow emergency zone when there is no declared snow emergency and for violations of alternate side parking for the entire city, including the snow emergency zone, during a declared snow emergency, resulting in the same fine for alternate side parking violation either inside or outside of the snow emergency zone during a declared snow emergency.
d.            Sec. 12.1339 is being amended to clarify the title of the ordinance (Clean Streets/Clean Lakes) to reflect the current program and to be consistent with the current parking sign language.  This amendment will modify the language of Sec. 12.1339(1) to include the removal of snow from the highways.  
e.            Sec. 1.08 is being amended to be consistent with the newly created Subsection (6) for violations of 12.1335, to retain the bail deposit for Sec. 12.1335(1) alternate side parking violation at a deposit of $20, and to increase Sec. 12.1335(4)(c) snow emergency parking violation from a deposit of $30 to $60.  
f.            Finally, the forfeiture range for MGO Sec. 12.1335 is being increased from a range of $5-$60 to $5-$100, the range being distinct from the bail deposit (ticket) amount.

The Common Council of the City of Madison do hereby ordain as follows:
1.      New Subdivision (d) of Subsection (4) entitled "Snow Emergency Parking" of Section 12.1335 entitled " Alternate-Side Parking And Snow Emergency Parking" of the Madison General Ordinances is created to read as follows:
"(d)      Any person violating Subsection (1) or (4)(c) of this ordinance is subject to towing and fees for towing pursuant to Section 12.1331, MGO."
2.      Current Subdivision (d) of Subsection (4) of Section 12.1335 of the Madison General Ordinances is renumbered to Subdivision (e).
3.      Subsection (6) entitled "Violations" of Section 12.1335 entitled " Alternate-Side Parking And Snow Emergency Parking" of the Madison General Ordinances is created to read as follows:
"(6)      Violations.
(a)      Any person violating Subsection (1) when there is no snow emergency is in violation of this section.
(b)      Any person violating Subsection (1) or (4)(c) during a snow emergency is in violation of this section."
4.      Section 12.1339 entitled "Street Sweeping Parking Restrictions" of the Madison General Ordinances is amended to read as follows:
"12.1339      STREET SWEEPING PARKING RESTRICTIONS CLEAN STREETS AND CLEAN LAKES PARKING RESTRICTIONS
(1)      In order to facilitate the removal of all manner of debris and snow from the highways and parts of highways located within this City's second, sixth and thirteenth aldermanic district, as defined by Section 15.03(6) of these ordinances, no person shall park, stop, or leave standing any motor vehicle on any highway or part of a highway where and when prohibited by an official traffic sign.  
(2)      The Traffic Engineer shall erect appropriate signs designating the restrictions of Subsection (1) of this ordinance.
(3)      Any person violating Subsection (1) of this ordinance shall be required to forfeit not less than five dollars ($5) nor more than fifty dollars ($50)."
5.       Subsection (2) of Section 12.141 entitled "Penalties For Violating Sections 12.122 Through 12.140" of the Madison General Ordinances is amended to read as follows:
"(2)      Any person violating Section 12.128(5), 12.1334(99), 12.1335 or 12.1336 shall be subject to a forfeiture of not less than five dollars ($5) nor more than sixty dollars ($60)"
6.       New Subsection (3) of Section 12.141 entitled "Penalties For Violating Sections 12.122 Through 12.140" of the Madison General Ordinances is created to read as follows:
"(3)      Any person violating Section 12.1335 shall be subject to a forfeiture of not less than five dollars ($5) nor more than one hundred dollars ($100)"
7.      Current Subsections (3)-(9) of Section 12.1335 of the Madison General Ordinances are renumbered to Subsections (4)-(10).
8.      Subdivision (a) of Subsection (3) entitled "Schedule of Deposits" of Section 1.08 entitled "Issuance of Citations for Violations of Certain Ordinances and Providing a Schedule of Cash Deposits" of the Madison General Ordinances is amended to read as follows:
"Alternate side parking (Nov 15-Mar 15).            12.1335(1)12.1335(6)(a)      $20
Alternate side parking (snow emergency).      12.1335(4)(c)12.1335(6)(b)      $3060"
 
EDITOR'S NOTE:      New bail deposits must be approved by the Municipal Judge prior to adoption.  This deposit has been so approved.
