Body
WHEREAS, the City of Madison, as the lessor, and Community Action Coalition of South Central Wisconsin, Inc. (“CAC”), as the lessee, are parties to a lease, dated May 22, 2007, pertaining to CAC’s use of a portion of the public greenway within Lucy Lincoln Hiestand Park, located at 1653 Frisch Road, for community gardening purposes; and

WHEREAS, the term of the lease is for a period of 5 years, commencing on January 1, 2007 and expiring on December 31, 2011, and continues thereafter for successive terms of one year each until terminated by either party; and

WHEREAS, the leased premises consists of approximately .38 acre (16, 553 square feet); and

WHEREAS, CAC desires to expand the leased premises to include an additional .37 acre (16,000 square feet) within the public greenway; and

WHEREAS, the City of Madison Engineering Division staff has reviewed and approves of the expansion of the leased premises; and

WHEREAS, the City of Madison Real Estate Section has prepared an amendment to the lease for such purpose, and CAC has reviewed and approves of the amendment.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are authorized to execute an amendment to the lease with Community Action Coalition of South Central Wisconsin, Inc., amending the existing lease as follows:

1. The leased premises shall be expanded to include the approximately additional area of approximately .37 acre (16,000 square feet) denoted as the “Expansion Area” on attached Exhibit A.

2. All other terms and conditions of the lease shall remain in full force and effect.
