Body
WHEREAS, Bruce Zauft and Karen Zauft (the "Owners") are the owners of the property located at 2912 Waunona Way (the "Property"); and
 
WHEREAS, as a condition of the conditional use permit for the Property, the City Engineering Division is requiring the Owners to grant to the City, at no cost to the City, a public sanitary sewer easement across the Property to accommodate existing public sanitary sewer facilities; and
 
WHEREAS, the Owners have executed the required easement; and
 
WHEREAS, the City Engineering Division has reviewed and recommends acceptance of the easement.
 
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison authorizes acceptance, at no cost to the City, of a Public Sanitary Sewer Easement from Bruce Zauft and Karen Zauft over the following described property (the "Easement Area"):
 
A 15-foot strip of land located within Lot 4, Block 2, Ethelwyn Park Lake Monona, located in the SW ¼ of the SE ¼ of Section 19 and the NW ¼ of the NE ¼ of Section 30, T7N, R10E, City of Madison, Dane County, Wisconsin, the centerline of which is described as follows:
 
Commencing at the Southwest corner of said Lot 4; thence N15°46'45"W, along the Westerly line of said Lot 4, 239.76 feet to the centerline of the existing sanitary sewer main and the point of beginning of this easement; thence N86°17'30"E, along said centerline, 85.06 feet to the Easterly line of said Lot 4 and the point of ending of this description which is located N12°36'56"E, 223.71 feet from the Southeaster corner of said Lot 4.
