Authorizing the Mayor and the City Clerk to sign a Municipal Deputization Agreement with the Dane County Sheriff's Office in order to deputize law enforcement officers employed by the Madison Police Department.
Body
WHEREAS, recent changes in the Wisconsin Statutes have resulted in the need for municipal law enforcement personnel to be deputized by a County agency in order to provide police services in specific circumstances; and,

WHEREAS, the Dane County Sheriff's Office is responsible for providing police services throughout the territorial limits of the County of Dane and is authorized pursuant to section 59.26(5) of the Wisconsin Statutes to deputize persons to perform particular acts; and,

WHEREAS, due to the close proximity of jurisdictional boundaries in the Madison area, it is mutually beneficial to the City and the Dane County Sheriff's Office for Madison Police Department law enforcement personnel to have the limited authority to act outside of their jurisdictional boundaries within Dane County; and,

WHEREAS, the Dane County Sheriff's Office requires the signing of a Municipal Deputization Agreement prior to deputizing municipal law enforcement officers; and,

WHEREAS, the Agreement contains a provision which requires the City to hold harmless, indemnify and defend the Sheriff and Dane County against liability, damage, claims or suits which arise out of the City's acts or omissions in connection with the agreement when a City police officer acts unilaterally under deputy authority and outside the City of Madison; and,

WHEREAS, pursuant to APM 1-1, the inclusion of such a provision requires the express approval of the Common Council.
