Authorizing the City Engineer to execute the Bridge Owner Certification Form that is required by the Wisconsin Department of Natural Resources as part of the Chapter 30 permit application necessary to build a pedestrian bridge over Starkweather Creek. (15th AD)
Body
WHEREAS the City of Madison plans to build a pedestrian bridge over Starkweather Creek just south of Darbo Drive as part of the Starkweather Bike Path Project.
WHEREAS the City must secure a Chapter 30 permit from the Wisconsin Department of Natural Resources to prior to constructing the bridge.
WHEREAS a Bridge Owner Certification Form must be submitted to DNR as part of the Chapter 30 permit application. The form states that the bridge shall be constructed in compliance with DNR requirements, shall be maintained in good repair, and that the Owner shall assume all responsibility and liability for any direct or indirect damage caused or resulting from the presence of the Bridge and hold the State of Wisconsin, or its employees, harmless, and shall take personal responsibility and liability for compliance with the above-stated provisions.
NOW THEREFORE BE IT RESOLVED that the City Engineer is authorized to execute the Bridge Owner Certification Form on behalf of the City of Madison.
BE IT FURTHER RESOLVED that the City of Madison shall assume all responsibility and liability for compliance with the provisions of this Certification and as agreed to by the City Engineer's signature.
