The stormwater utility shall fund the costs associated with this agreement with funds in Acct. No. ESTM-54930-562810. The City of Madison share of project cost is not to exceed $5,000.00. Final cost may be less depending on the number of municipalities that agree to become part of this group.

Authorizing the Mayor and City Clerk to execute an Agreement for the Establishment and Operation of the Rock River TMDL Group, to jointly participate in the Rock River TMDL process discussions with the WDNR and its agents. (Various ADs)
Body
WHEREAS, the City of Madison has stormwater discharging to the Rock River Watershed; and
WHEREAS, the Wisconsin Department of Natural Resources (WDNR) has approved and is working with the Environmental Protection Agency (EPA) on creation of a Total Maximum Daily Load (“TMDL”) standard for phosphorous and total suspended solids (TSS) discharges to the Rock River watershed; and
WHEREAS, the City of Madison has a significant financial interest in standards being set for stormwater discharges to this water system; and
WHEREAS, the law firm of Anderson & Kent S.C. has in the past represented groups of regulated municipalities in discussions with the WDNR as part of similar regulatory processes, and is organizing a group of municipalities in Eastern and South Central Wisconsin to represent as part of the current Rock River TMDL process, in accordance with the terms and conditions of a certain Section 66.0301, Wis. Stats., intergovernmental cooperation Agreement for the Establishment and Operation of the Rock River TMDL Group; and
WHEREAS, the cost of being part of this Rock River TMDL Group is modest compared to the potential cost of the forthcoming TMDL regulations to the City of Madison;
