DRAFTER'S ANALYSIS: This ordinance repeals sec. 23.01(4), MGO. This subsection of the ordinances has been superseded by Wis. Stat. sec. 66.0903(6), which now governs the City's ability to bid separately or jointly for work on public contracts.

Pursuant to Section 66.0101 Wis. Stats., 2003-04, the Common Council of the City of Madison do ordain as follows:

1. Subsection (4) entitled "Separation of Contracts and Combined Bids" of Section 23.01 entitled "Regulating Of Public Work" of the Madison General Ordinances is hereby repealed.

2. Pursuant to sec. 66.0101, Wis. Stats., this Charter Ordinance shall take effect 60 days after publication, subject to the referendum rights in sec. 66.0101(5), Wis. Stats.


EDITOR'S NOTE: Section 23.01(4) currently reads as follows:

"(4) Separation of Contracts and Combined Bids. The Board of Public Works shall take separate bids for (a) General Construction, (b) Plumbing, (c) Heating, Ventilating and Air Conditioning, and (d) Electrical divisions of the work on the repair, remodeling or improvement of any public building or structure other than highway structures. The Board may take separate bids on any other divisions or subdivision of the work it designates. Combination bids may also be requested by the Board for combination of the above divisions of the work provided any bidder who submits a combined bid also submits separate bids for all the divisions comprising the combined bid.
