Creating Section 23.37 of the Madison General Ordinances to prohibit interfering with a mother breastfeeding and amending Section 1.08(3) of the Madison General Ordinances to establish the bail deposit amount for violation of this section.

DRAFTER'S ANALYSIS: This ordinance creates a right to publicly breastfeed a child.

The Common Council of the City of Madison do hereby ordain as follows:
1. Section 23.37 entitled "Interfering with Breastfeeding Prohibited" of the Madison General Ordinances is created to read as follows:
"23.37 INTERFERING WITH BREASTFEEDING PROHIBITED
Notwithstanding any other provision of law, a mother or her surrogate may breastfeed her child and may express breastmilk in any location, public or private, except the private home or residence of another, where the mother or her surrogate and the child are otherwise authorized to be present. Any person who intentionally interferes with a mother's or her surrogate's attempts to breastfeed her child or to express breastmilk, except the owner or resident of a private home or residence, shall be subject to a forfeiture of not less than $25.00 nor more than $250.00 for each such violation."
2. Subdivision (a) of Subsection (3) entitled "Schedule of Deposits" of Section 1.08 entitled "Issuance of Citations for Violations of Certain Ordinances and Providing a Schedule of Cash Deposits" of the Madison General Ordinances is amended by creating therein the following:
"Interfering with Breastfeeding 23.37 $50"
