Amending Sections 3.11(4)(b) and (6), 3.21(5)(a), 3.35(1)(z), 3.38(1)(b), 3.38(1)(j)2., 8.13, 12.128(4)(c)4., and 35.02(b) of the Madison General Ordinances to change the name of the Motor Equipment Division to the Fleet Service Division.

DRAFTER'S ANALYSIS:  This ordinance amends various sections of the Madison General Ordinances to reflect that the name of the Motor Equipment Division is to be changed to the Fleet Service Division.

The Common Council of the City of Madison do hereby ordain as follows:
 
1.      Subdivision (b) of Subsection (4) entitled "Divisions" of Section 3.11 entitled "Department of Public Works" of the Madison General Ordinances is amended to read as follows:
 
"(b)      The Division of Motor Vehicle Equipment Fleet Service" shall be directly responsible for the management, supervision, servicing, maintenance and repair of all municipal motor equipment, including boats."
 
2.      Subsection (6) entitled "The Director of Public Works" of Section 3.11 entitled "Department of Public Works" of the Madison General Ordinances is amended to read as follows:
 
"(6)      The Director of Public Works. The Department of Public Works shall be managed and directed by a Director of Public Works. Effective March 1, 1989, the position of Director of Public Works as it becomes vacant shall be filled according to Sec. 3.38(6)(f) of these ordinances. The incumbent of the position as of the above date may enter into an employment contract as described in such section at his or her option. He/she shall, together with the division heads, be charged with the duty of preparing and presenting the annual operating and capital budgets of the several divisions of the department. Such Director shall have full authority to establish technical standards, methods, and procedures for the department and its divisions and to see that they are properly executed. He/she shall have authority to employ, assign, or reassign all personnel within the various divisions and to resolve all disputes between the divisions and conflicting demands for labor and equipment. All public works construction plans adopted by the Common Council shall be carried out by him/her according to design and time schedules within allocated budgets. Effective March 1, 1989, the positions of City Engineer, Streets Superintendent, Superintendent of Parks and Motor Equipment Fleet Service Superintendent as they become vacant shall be filled according to Sec. 3.38(6)(f) of these ordinances. The incumbent of the position as of the above date may enter into an employment contract as described in such section at his or her option."
 
3.      Subdivision (a) entitled "Membership" of Subsection (5) entitled "Emergency Management Planning Staff Team" of Section 3.21 entitled "Emergency Management " of the Madison General Ordinances is amended to read as follows:
 
"(a)      Membership.
The Emergency Management Planning Staff Team shall consist of the following individuals or their designees:  City Attorney, City Engineer, Comptroller, Fire Chief, Police Chief, Street Superintendent, Director of Motor Equipment Fleet Service Superintendent, Building Inspection Director, Director of Public Health, Forestry Supervisor.  With approval of the Mayor, the Planning Team may be expanded to include other City agency heads."
 
4.      Subdivision (z) of Subsection (1) entitled "Civil Service Created - Exceptions Therefrom" of Section 3.35 entitled "Civil Service System" of the Madison General Ordinances is amended by amending therein the following:
 
"(z)      Motor Equipment Fleet Service Superintendent."
5.      Subdivision (b) of Subsection (1) entitled "Basic Salary Schedules By Compensation Groups" of Section 3.38 entitled "Compensation Plan" of the Madison General Ordinances is amended by amending therein the following:
 
"Motor Equipment Fleet Service Maintenance Supervisor"
 
6.      Paragraph 2. of Subdivision (i) of Subsection (1) entitled "Basic Salary Schedules By Compensation Groups" of Section 3.38 entitled "Compensation Plan" of the Madison General Ordinances is amended by amending therein the following:
 
"Motor Equipment Fleet Service Superintendent"
 
7.      Subdivision (b) entitled "Positions" of Subsection (1) entitled "Compensation of Managerial Employees" of Section 3.38 entitled "Compensation Plan" of the Madison General Ordinances is amended by amending therein the following:
 
"Motor Equipment Fleet Service Superintendent"                                                                         
 
8.      Section 8.13 entitled "Motor Equipment Division" of the Madison General Ordinances is amended to read as follows:
 
"8.13       MOTOR EQUIPMENT FLEET SERVICE DIVISION.
(1)      The Motor Equipment Fleet Service Division shall be supervised by the Motor Equipment Fleet Service Superintendent.
(2)      The Motor Equipment Fleet Service Superintendent shall have supervision over the Municipal Service Garage and shall be responsible for servicing, maintenance and repair of all municipal motor equipment. He shall advise the Mayor, Common Council and all City officials on all matters relating to municipal motor equipment, including replacement and procurement."
 
9.      Paragraph 4. entitled "Disposal of Abandoned Vehicles" of Subdivision (c) entitled  "Removal, Storage, Notice, Reclaimer or Disposal of Abandoned Vehicles" of Subsection (4) entitled "Vehicle Abandonment Prohibited; Removal; Disposal" of Section 12.128 entitled "Miscellaneous Restrictions On Parking" of the Madison General Ordinances is amended to read as follows:
 
"4.      Disposal of Abandoned Vehicles. Any abandoned vehicle impounded by the City of Madison which has not been reclaimed or junked or sold by direct sale to a licensed salvage dealer pursuant to the provisions hereof, may be sold by public auction sale or public sale calling for the receipt of sealed bids, pursuant to Sec. 342.40(3)(c), Wis. Stats. Class 1 Notice, including the description of the vehicle, the name(s) and address(es) of the owner and lienholders of record, if known, as well as the information contained in the notice sent to the owners and lienholders of record, and the time of sale, shall be published before the sale, at which sale the highest bid for any such motor vehicle shall be accepted unless it is deemed inadequate by the Police Chief or designee in which case all bids may be rejected. Any interested person may offer bids on each abandoned vehicle to be sold. If all bids are rejected or no bid is received, the Chief of Police or his designee may readvertise the sale, adjourn the sale to a definite date, sell the motor vehicle at a private sale or junk the vehicle without further public notice. In lieu of a sale, if any abandoned vehicle remains unclaimed 30 days after notice has been sent under subsection (4)(b)3., the Chief of Police or designee may notify the Superintendent of Motor Equipment Fleet Service or designee that the vehicle is available. The Superintendent of Motor Equipment Fleet Service or designee shall determine whether it is in the best interests of the City to keep the vehicle for municipal purposes. An inventory of all such vehicles retained by the City shall be maintained by Motor Equipment Fleet Service pursuant to section 66.0319 of the Wisconsin Statutes, unless allocated to an agency which maintains its own fleet, in which case that agency shall maintain the inventory. The proceeds from the sale of any vehicle under this subsection shall be put in a segregated fund to be used for the costs associated with the acquisition of vehicles under this subsection, and any net proceeds after deducting such costs may be used for vehicle-related costs."
 
10.      Subdivision (b) of Subsection (2) entitled "Administration" of Section 35.02 entitled "The Public Sewerage System" of the Madison General Ordinances is amended to read as follows:
 
"(b)      The Madison Sewer Utility shall enter into agreements with the Water Utility in order to purchase and compensate for essential services; said agreements approved by the Board of Public Works and ratified by the Common Council. The Madison Sewer Utility is directed to arrange assignments with other City departments and divisions for specific services and compensation credits; said agreements approved by the Board of Public Works and ratified by the Common Council. Services would be provided by, but not restricted to: the Engineering Division, for administration, engineering and maintenance; the Accounting Division, for accounting services; the Division of Motor Equipment Fleet Service; the Department of Information Services; and the Health Division."
