Authorizing the execution of a Permanent Limited Easement for radio tower guy wire anchors to Northwestern College Radio on a City-owned property located at 7022 Raymond Road. 1st Ald. Dist.
Body
WHEREAS, Northwestern College Radio, headquartered in St. Paul, Minnesota, owns and operates a radio tower for their local FM/AM station, which is located adjacent to Elver Park, north of Raymond Road; and
WHEREAS, after a recent inspection of the tower as required by the FCC, Northwestern College Radio was required to remove and replace the tower and guy wires due to metal fatigue; and
WHEREAS, as part of reconstruction of the radio tower, Northwestern College Radio, requested two easements for guy wire anchors located on City-owned property at Elver Park; and
WHEREAS, the City Parks Division has reviewed and approves of the Easements.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute a Permanent Limited Easement for Guy Wire Anchors with Northwestern College Radio for the Easements described as follows:
Two easement areas located in the Southeast ¼ of the Southeast ¼, and in the Northeast ¼ of the Southeast ¼ of Section 35, Town 7 North, Range 8 East, City of Madison, Dane County, Wisconsin, more particularly described as follows:
Easement Southeast:
Commencing at the Southeast corner of said Section 35; thence along the East line of said Southeast ¼, N00°54'51"E 1320.34 feet to the Northeast corner of said Southwest ¼ of the Southeast ¼; thence S23°25'25'W 914.43 feet to a ¾-inch iron pipe, and the point of beginning;
Thence S23°25'25" E 119.12 feet to "Point A"; thence N66°34'35"E 50.00 feet; thence S23°25'25"E 75.00 feet; thence S66°34'35"W 50.00 feet; thence N23°25'25"W 75.00 feet to said Point A.
Easement Northeast:
Commencing at the Southeast corner of said Section 35; thence along the East line of said Southeast ¼, N00°54'51"E 1320.34 feet to the Northeast corner of said Southwest ¼ of the Southeast ¼; thence S23°25'25'W 914.43 feet to a ¾-inch iron pipe, and the point of beginning;
Thence S23°25'25" E 119.12 feet to "Point A"; thence S00°33'51"W 79.40 feet; thence N89°26'99"W 51.01 feet; thence N33°16'59"E 94.38 feet to said Point A.
