Title: To SUSPEND the handcrafted goods, personally prepared food vending restrictions and INVALIDATE Mall/Concourse vending licenses from 6:00 p.m. July 7 to 9:00 p.m. July 9, 2006 in the areas specified below for the benefit of the Madison Museum of Contemporary Art, so that the 48th Annual ART FAIR ON THE SQUARE may occur.

To SUSPEND the handcrafted goods, personally prepared food vending restrictions and INVALIDATE Mall/Concourse vending licenses from 6:00 p.m. July 7 to 9:00 p.m. July 9, 2006 in the areas specified below for the benefit of the Madison Museum of Contemporary Art, so that the 48th Annual ART FAIR ON THE SQUARE may occur.
Body
WHEREAS, Section 9.13(6) of the Madison General Ordinances and the regulations adopted therein control street vending on the State Street Mall/Capitol Concourse area; and

WHEREAS, Section 9.13 (6)(k)1. allows the Common Council to suspend specifically enumerated vending ordinances or regulations and establish alternate rules and procedures during a special event; and

WHEREAS, Section 9.13(6)(k)3. authorizes the Common Council to invalidate street vending licenses, Mall-Concourse Vending Licenses and sidewalk cafe licenses within the perimeter of a special event in order to encourage the integrity, comprehensiveness and success of a special event; and

WHEREAS, the48th Annual ART FAIR ON THE SQUARE is such a special event; and

WHEREAS, the Madison Museum of Contemporary Art, as sponsor of the event, agrees to obtain a Street Use Permit for the setup and conduct of this event from 6:00p.m. July 7 to 9:00p.m. July 9, 2006 and agrees to comply with the conditions of the permit, including but not limited to any conditions placed on the permit by the Street Use Staff Team; and

WHEREAS, the sponsor of the event, the Madison Museum of Contemporary Art wishes to insure the integrity, comprehensiveness and success of the 48th Annual ART FAIR ON THE SQUARE by retaining control over the vending of both goods and food, and has demonstrated that special conditions exist which warrant such action by the Council; and
