Preamble
 
The Developer of the plat known as Linden Park desires to plat a public alley known as outlot 13 at a width of 26 feet.  Outlot 13 abuts lots 126-153 of the Linden Park Plat.  Ten of the lots, lots 131-140 have no access to a public street and therefore their primary access is off of the alley.  Emergency services responding to a call involving lots 131-140 will be required to use the alley.  Typical alley widths are not adequate for many of the emergency vehicles that typically respond to incidents.  Therefore, in the interest of public safety, the Madison Fire Department will require that the alley pavement width be expanded to 20 feet.  The platted alley right of way width of 26 feet, and the pavement width of 20 feet increase the likelihood that City snow plows will damage private property adjacent to the alley because only 3 feet of separation exists between the edge of pavement and the property line.  Therefore, the City Engineer is requiring that an indemnity agreement be recorded against all lots abutting Outlot 13 to insure that the City is not held responsible for the cost to repair private property adjacent to the alley.  
 
NOW THEREFOR BE IT RESOLVED, that the Mayor and City Clerk are hereby authorized to execute an agreement between the City of Madison and MB Investments of Wisconsin, LLC for indemnification for snow plow damage for lots 126-153 of the plat known as Linden Park.
