Body
WHEREAS, the City Engineering Division is reconstructing East Washington Avenue - Segment 2 from Thornton Avenue to Second Street in 2006; and

WHEREAS, as part of the East Washington Avenue reconstruction project, Wisconsin Bell is required to move their existing overhead telecommunication line and cabinet facility, which are located along East Washington Avenue near South First Street; and

WHEREAS, Wisconsin Bell has requested a ten foot by twenty-four foot utility easement ("Easement") across a City-owned property located at 1903 East Washington Avenue, which is a remnant parcel remaining from the proposed East Washington Avenue/First Street reconstruction; in order to relocate their existing overhead telecommunication line and cabinet facility; and

WHEREAS, the City Engineering Division has reviewed and approves of the Easement.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Utility Easement with Wisconsin Bell d/b/a SBC Wisconsin for the Easement described as follows:

A parcel of land measuring ten (10) feet by (24.05) feet, being a part of a lot 1, Block 1 of Wakeley's Subdivision of a part of Block 278, 282, 285, 287 and 294, Farewell's Replat of the City of Madison, City of Madison, Dane County, Wisconsin, more particularly described as follows:


Commencing at the Southeast corner of said Lot 1, Block 1; thence South 44°18'26"W along the Southeasterly line of said Lot 1, 24.05 feet to a point being on the Northeasterly right-of-way line of South First Street; thence N445°45'28"W along said Northeasterly right-of-way line, 10.00feet to a point; thence N44°18'26"E and parallel to the Southeasterly line of said Lot 1, ...
