WHEREAS, at its meeting of December 14, 2004, the Common Council approved Resolution No. 62100, ID No. 37114, authorizing the Mayor and City Clerk to adopt a relocation order for a Permanent Limited Easement (PLE) and the Temporary Limited Easement (TLE) from Ruth M. Vetter for public sanitary sewer and storm water improvements.
 
WHEREAS, at its meeting of June 21, 2005, the Common Council approved Enactment Number RES-05-00561, File Number 01326, authorizing the Mayor and City Clerk to advertise and receive bids for Valley View Sanitary and Drainage Impact Fee District, Contract No. 5825; and
 
WHEREAS, the easement agreements require that the City indemnify Ruth M. Vetter; and
 
WHEREAS, City APM 1-1 requires Council approval whenever the City indemnifies another party.
 
NOW THEREFORE, the Common Council approves the indemnification of Ruth M. Vetter as specified in the easement agreements in order to construct and maintain public facilities within the Permanent Limited Easement (PLE) and the Temporary Limited Easement (TLE) located on her property.
