Approving temporary construction work with associated noise impacts between the hours of 7:00 PM and 7:00 AM on Howard Place.

PREAMBLE
The City has proposed to reconstruct Howard Place from Langdon Street to the cul-de-sac. The proposed work includes resurfacing of the street, spot repairing of curb and gutter, replacing of storm sewer main, sanitary sewer main, water main and sanitary laterals. For a regular reconstruction project of this size, it usually takes approximately two months to complete the proposed work. Due to the limitation of vehicular access during the construction, Fire Department and Police Department have recommended to reduce the length of construction and perform the proposed work when the vicinity of the area is in its low density in order to reduce inconvenience. The work is planned for 2005. The City has proposed to start the construction on May 19th, four days after the commencement weekend and complete by June 13th, the start of the 8-week summer session.
The proposed activities beyond the hours of 7:00 AM to 7:00 PM are as follows:
1. General Construction Activities between the hours of 7:00 AM and 9:00 PM. The extension of the work hours will allow the contractor to work double shifts in order to achieve the time limit of the project.
Construction activities generally exceed the noise limits imposed by the Madison General Ordinances and temporary construction activity between the hours of 7:00 AM to 7:00 PM is allowed to exceed the noise limits imposed by the Madison General Ordinances. Madison General Ordinance section 24.08(3) provides the Common Council the ability to allow construction activities, with associated noise impacts, outside of the hours of 7:00 AM to 7:00 PM. with the passage of a resolution.
