Fiscal Note
The proposed resolution authorizes the Mayor and City Clerk to enter into a noncompetitive contract for Purchase of Services with Arch Solar C&I to remove hail damaged solar modules and install new modules at the Madison Public Market at 202 N First St at an estimated cost of $107,532. Funding for the contract is available in the 2026 Adopted Engineering Capital Budget in the Energy Improvements Program (Munis #16368). It is anticipated that an insurance reimbursement will cover the cost of this contract and the budget will be amended in a future resolution to reflect the insurance reimbursement. At this time, no additional appropriation is required.

WHEREAS, in 2023, City Engineering advertised and received bids for a public works contract (8595) for the construction of the Madison Public Market in accordance with WI State Statue 66.0901; and
WHEREAS, the construction project included an alternate (No. 3) to provide a photovoltaic array and all related work that was accepted and awarded with the construction contract; and
WHEREAS, Arch Solar C&I was the subcontractor responsible for installation of the photovoltaic array for the public works contract; and
WHEREAS, Arch Solar C&I completed the installation of the photovoltaic array and the system was given permission to operate from the electrical utility on June 9, 2025; and
WHEREAS, the public works contract specifications for the photovoltaic array included a two year workmanship warranty; and
WHEREAS, 315 of the photovoltaic array’s modules were damaged by hail on April 14, 2026; and
WHEREAS, the damaged modules need to be removed and new modules need to be installed; and
WHEREAS, this will require a contractor that is familiar with the existing photovoltaic array and that will maintain the array’s workmanship warra...
