SUBSTITUTE Amending Section 34.308 of the Madison General Ordinances to prohibit the use of large grills on balconies.

DRAFTER'S ANALYSIS: The International Fire Code was amended and now includes the relevant language found in Section 34.308. This ordinance removes exception three of the IFC which permits LP gas containers with a water capacity greater than 2½ pounds to be used on balconies.

The Common Council of the City of Madison do hereby ordain as follows:
Section 34.308 entitled "Open Flames" of the Madison General Ordinances is amended to read as follows:
"34.308 OPEN FLAMES.
IFC section 308.1.4 shall be replaced with the following language: amended to remove Exception three (3).
(1) Charcoal burners and other open-flame cooking devices shall not be operated on combustible balconies or within ten (10) feet of combustible construction. Exceptions:
(a) One- and two-family dwellings.
(b) Where buildings, balconies and decks are protected by an automatic sprinkler system.
(2) LP-gas burners having an LP-gas container with a water capacity greater than two and a half (2½ ) pounds [nominal 1 pound (0.454 kg) LP-gas capacity] shall not be stored or operated on balconies unless they are served by exterior stairways. Exceptions:
(a) One- and two-family dwellings.
(b) Where buildings, balconies and decks are protected by an automatic sprinkler system."
EDITOR'S NOTE: The text of Exception (3) from IFC section 308.1.4 reads as follows:
"3. LP-gas cooking devices having LP-gas container with a water capacity not greater than 2-1/2 pounds [nominal 1 pound (0.454 kg) LP-gas capacity]."
