Approving temporary construction work with associated noise impacts between the hours of 7:00 PM and 7:00 AM on Alley Block 101. (4th AD)

PREAMBLE
It was determined through a survey of the property owners/ business owners/ residents that the optimum time to line the sanitary sewer main in the Block 101 Alleyway (see attached project location map) is during the night time hours. This is the time of day with the least amount of water is used. This work cannot be completed between the hours of 7:00 AM and 7:00 PM without causing major disruption to the businesses with particular interest being the restaurants. We are aware that there is a bar within the project limits that will be most effected by doing the project at night but the contractor will be instructed to do the project on the slowest night of the week. It is expected that this night lining work will last one night. The remainder of the project can be completed during the daytime hours without disrupting the businesses. The equipment used for this lining work that will exceed the maximum noise limits are a large generator and steamer unit which has an air compressor connected to it. It should be noted that this type of construction is the quickest most efficient way to rehabilitate the city sanitary sewer. There will not be any open trench work with this project and the majority of the project will be completed in one night. This project has previously been approved for construction.
Construction activities generally exceed the noise limits imposed by the Madison General Ordinances and temporary construction activity between the hours of 7:00 AM to 7:00 PM is allowed to exceed the noise limits imposed by the Madison General Ordinances. Madison General Ordinance section 24.08(3) provides the Common Council the ability to allow construction activities, with associated noise impacts, outside of the hours of 7:00 AM to 7:00 PM. with the passage of a resolution.
