Title
Authorizing the execution of an Underground Utility Easement to Wisconsin Bell d/b/a AT&T across a portion of a City-owned Stormwater Utility parcel located at 5307 Lien Road.
Body
WHEREAS, Wisconsin Bell d/b/a AT&T ("AT&T") is relocating underground telecommunication facilities along Lien Road, in conjunction with the City of Madison Engineering Project No. 53W0127 Lien Road reconstruction; and
WHEREAS, as part of the relocation of the underground telecommunication facilities, AT&T has requested a ten (10) foot wide underground telecommunication line easement ("Easement") across a portion of a City-owned Stormwater Utility parcel located at 5307 Lien Road; and
WHEREAS, AT&T will jointly occupy an existing MG&E underground utility easement that was granted by the City of Madison in October of 2009; and
WHEREAS, the City Engineering Division has reviewed and approve of the Easement.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Underground Utility Easement with Wisconsin Bell d/b/a AT&T for the Easement described as follows:
A strip of land, ten (10) feet in width, located in part of the Outlot 2, Ridgewood the Drumlin Addition, in the NEĀ¼ of Section 34, Town 8 North, Range 10 East, City of Madison, Dane County, Wisconsin, said the centerline of said easement strip being more particularly described as follows:
The right-of-way shall be located five (5) feet on the right side and five (5) on the left side of the centerline of the Grantee's facilities as constructed. The facilities will be located approximately as set forth in the drawing attached hereto as Exhibit "A" and dated August 13, 2009
