WHEREAS, This segment of Lone Oak Lane was originally a Town of Middleton town road annexed to the City of Madison; and
 
WHEREAS, The Linden Park Proposed Preliminary Plat, has been submitted to the City of Madison for approval, and proposes a different alignment for Lone Oak Lane; and
 
BE IT RESOLVED, pursuant to Sec. 66.1003(4)(a), Wisconsin Statutes, the City of Madison declares it is in the public interest to vacate/discontinue:
Part of Lone Oak Lane, located in the NW1/4 of the NW1/4 of Section 34, T07N, R08E, City of Madison, formerly the Township of Middleton, Dane County, Wisconsin, to-wit:
Commencing at the Northwest corner of said Section 34; thence N 88°48'23" E, along the North line of said NW1/4, 150.00 feet; thence S 02°34'52" W, 33.07 feet to the point of beginning; thence N 88°48'23" E, 66.14 feet; thence S 02°34'52" W, 334.89 feet; thence S 03°23'28" W, 955.61 feet; thence S 88°47'06" W, 66.21 feet; thence N 03°23'28" E, 960.53 feet; thence N 02°34'52" E, 330.03 feet to the point of beginning. Contains 1.96 acres.
 
BE IT FURTHER RESOLVED, proposed vacation area is mapped on Exhibit A on Page 2 of this resolution; and
 
BE IT FURTHER RESOLVED, the vacated right-of-way shall revert adjacent owner which is to be replatted in the proposed Linden Park subdivision; and
 
BE IT FURTHER RESOLVED, Any existing public or private easement or incidental rights within the vacated rights-of-way shall be located within new utility easements or rights-of-way created by the proposed Linden Park subdivision; and
 
BE IT FURTHER RESOLVED, if for any reason, the proposed Linden Park subdivision is not approved by the City of Madison and recorded with the Dane County Register of Deeds, the vacated portion of Lone Oak Lane reverts to public right-of-way.
