Vacation/Discontinuance of Spruce Street, Willow Street and Oak Street lying southerly of existing Olin Avenue, within City of Madison Park known as Goodman Park, more particularly described in resolution body.
Body
WHEREAS, The City of Madison proposes to construct a swimming pool facility in Franklin Field, a City park; and
WHEREAS, Franklin Field was acquired by the City from various owners from the 1900's through the 1980's, and public street rights-of-way that have never been improved, nor are planned to be improved, still exist within that area for Spruce Street, Willow Street and Oak Street; and
WHEREAS, said street rights-of-way are no longer needed for public street purposes, as the entire Franklin Field is owned by the City for park purposes; and
WHEREAS, Said street rights-of-way must be vacated/discontinued in order to construct a swimming pool facility at that location;
BE IT RESOLVED, pursuant to Sec. 66.1003(4)(a), Wisconsin Statutes, the City of Madison declares it is in the public interest to vacate/discontinue:
All of Spruce Street lying in Government Lot 1 of Section 26, and in the Northeast 1/4 of the Southeast 1/4 of Section 26, Town 7 North, Range 9 East, including Spruce Street as platted in Orchard Lawn Addition to South Madison and in Lakeside Addition to South Madison;
and that part of Willow Street as platted in Orchard Lawn Addition to South Madison, lying south of the southerly right-of-way line of West Olin Avenue as presently located;
and that part of Oak Street as platted in Lakeside Addition to South Madison, lying south of the southerly right-of-way line of West Olin Avenue as presently located.
BE IT FURTHER RESOLVED , proposed vacation areas are mapped and part of this resolution; and
BE IT FURTHER RESOLVED, under Section 80.32(4), Wisconsin Statutes, any existing public or private easement or incidental rights within the vacated rights-of-way are perpetuated unless s...
