Fiscal Note
The YMCA will pay the City $5,021.43 for use of the premises in 2006. Payments are to be made in installments on June 6 and August 1 of 2006. No appropriation is required. There is no anticipated impact upon cost controls.

Authorizing the Mayor and City Clerk to enter into a Use Agreement with the YMCA of Dane County, Inc. for the YMCA's non-exclusive use of Elver Park for a summer day camp in 2006 with the possibility of a one year renewal.
Body
WHEREAS, the YMCA of Dane County, Inc. ("YMCA"), has been successfully providing a weekday, daytime summer camp for YMCA participants at Elver Park since 2002 through a Use Agreement with the City of Madison ("CITY"), which expired on August 26, 2005; and
WHEREAS, the YMCA wishes to continue offering a daytime summer camp at Elver Park for the 2006 summer season; and
WHEREAS, the Parks Division has ensured that Madison residents will still have access to Elver Park facilities including a shelter, restrooms, basketball courts and baseball diamonds during the summer of 2006; and
WHEREAS, the YMCA will pay all maintenance costs and permitting fees as well as provide adequate general liability insurance and a five thousand dollar ($5,000) damage deposit for their non-exclusive use of the park.
NOW, THEREFORE, BIT IT RESOLVED, that the Mayor and City Clerk be authorized to enter into a Use Agreement on behalf of the City with the YMCA for the YMCA's non-exclusive use of Elver Park facilities for a summer 2006 weekday camp with the possibility of a one year renewal according to terms and conditions mutually agreed upon by the parties.
