Repealing Section 8.10 of the Madison General Ordinances to eliminate an obsolete section, Civic Recreation Center.

DRAFTER'S ANALYSIS: This ordinance repeals a section of the Madison General Ordinances that has been obsolete since at least 1972. The ordinance, Sec. 8.10, establishes a “Civic Recreation Center” pursuant to the authority set forth in Wis. Stat. § 43.49. When enacted on June 12, 1942 (File Number 11,626), this ordinance allowed for the establishment of a civic recreational center that was located at 14-20 E. Doty Street. Based upon other City records that have been located (Res. No. 32,740, adopted on March 28, 1978), this civic recreation center was eventually built and served as USO and community center until 1972, at which point the property was declared surplus and sold to adjoining landowners. The site is now part of Block 89. Hence, the ordinance addresses a building that has not existed for 43 years. Accordingly, this ordinance no longer serves a purpose and should be repealed.

The Common Council of the City of Madison do hereby ordain as follows:
Section 8.10 entitled “Civic Recreation Center” of the Madison General Ordinances is hereby repealed.
EDITOR’S NOTE:
Section 8.10 currently reads as follows:
“8.10 CIVIC RECREATION CENTER.
(1) In pursuance of the provisions of Section 43.49(1) of the Wisconsin Statutes, there shall be and there is hereby established a Civic Recreation Center for the use of the inhabitants of the City of Madison.
(2) The management of the Civic Recreation Center shall be under the supervision of the Board of Education.”
