Approving a Certified Survey Map of property owned by McKenzie 300 Corporation located at 1-15 and 2-8 River Birch Court and 809 Big Stone Trail; 9th Ald. Dist.
Body
WHEREAS a Certified Survey Map of property owned by McKenzie 300 Corporation located at 1-15 and 2-8 River Birch Court and 809 Big Stone Trail, City of Madison, Dane County, Wisconsin has been duly filed for approval by the Plan Commission, its Secretary or his/her designee, as provided for in Section 16.23(5)(g) of Madison General Ordinances; and
WHEREAS the proposed Certified Survey Map requires the vacation/ discontinuance of River Birch Court as established on the final plat of Eighth Addition to Blackhawk; and
WHEREAS a petition to vacate said right of way has been submitted to the City Engineer (Resolution ID 28094) and has been scheduled for review by the Board of Public Works; and
WHEREAS Chapter 236, Wisconsin Statutes requires that the Madison Common Council approve any dedications proposed or required as part of the proposed division of the lands contained on said Certified Survey Map;
NOW THEREFORE BE IT RESOLVED that said Certified Survey Map, bond and subdivision contract, subsequent affidavits of correction, parkland acquisition documents, easement or right-of-way release or procurement documents or any other related document or documents as deemed necessary by the Secretary of the Plan Commission in accordance with the approval of said Certified Survey Map are hereby approved by the Madison Common Council.
BE IT FURTHER RESOLVED that Resolution ID 28094, vacating/ discontinuing River Birch Court from Trappers Trail/ Big Stone Trail to its eastern terminus, shall be recorded at the Dane County Register of Deeds as required by the City Engineer, and the vacated right of way properly reflected on the final Certified Survey Map submitted for final approval and recording.
