DRAFTER'S ANALYSIS: Lately, Mall Concourse maintenance staff, who are responsible for the emptying of the public trash cans on State Street and within the Mall Concourse area, have noticed that adjacent business, news box operators, food carts, and other commercial entities have been using the City’s public trash cans to dispose of their commercial waste. This has led to them having to empty the City’s trash cans more frequently and bins being filled up leaving no room for the public. These public trash cans are meant for the public to use so that trash and refuse is not improperly disposed of and State Street and the Mall Concourse remain safe, sanitary and free of vermin or other pests. Private property owners and commercial interests should, and are required to, secure other means to dispose of their refuse and waste-whether through a dumpster or even the City’s weekly garbage collection program. This ordinance amendment, in addition to rearranging the existing language, makes it clear that property owners and commercial interests are not to use the City’s public trash receptacles. This limitation does not apply to customers of the business. This substitute is meant to clarify that the disposal of trash in the City receptacles that is not related to the use of the property or the business operation is not a violation of the prohibition. Throwing out food waste from a restaurant would be a violation; an employee throwing out a candy wrapper would not.
