Fiscal Note
Under terms of the agreement, the City will provide Police ($5,150), Fire ($700), Parks ($2,910), and miscellaneous services ($600) for a total estimated cost of $9,360. The Contractor will pay at least $2,055 in various permit and scheduling fees, and will also pay actual costs of Police staffing. The Contractor will also pay actual costs for the Parks employee on duty at an hourly rate of $45.40 All actual charges for services and personnel shall be billed to Madison Opera, Inc. following the event when all requested services and permits have been finalized and final charges for all staff time for the various agencies has been determined. Madison Opera, Inc. shall pay the billing in full no less than 30 days following receipt of the invoice. No additional appropriation is necessary.

To authorize the Mayor and City Clerk to sign a lease agreement between the City and Madison Opera Inc., for use of Garner Park on July 25, 2009, for Opera in the Park. (A.D. 19)
Body
WHEREAS, Madison Opera, Inc wishes to use City-owned Garner Park as the site of its 7th annual Opera in the Park to be held July 25, 2009, with a rain date of July 26, 2009; and
WHEREAS, the Common Council finds that it is in the public interest to provide the use of Garner Park, City services and equipment at cost to Madison Opera, Inc. in support of its annual Opera in the Park, a community event free to the public; and
WHEREAS, a short term lease agreement is the most efficient way to record the specific terms and conditions of Madison Opera's use of City park land for its annual Opera in the Park event.
NOW, THEREFORE, LET IT BE RESOLVED that the Mayor and City Clerk are authorized to enter into a short term lease agreement on behalf of the City with Madison Opera Inc., for its use of Garner Park and City services and equipment for its annual Opera in the Park to be held on July 25, 2009, with a rain date of July 26, 2009.
