Fiscal Note

The proposed ordinance amends the Madison General Ordinances to allow additional reconsideration opportunities when an alder was absent at the time of a vote on a matter. There is no fiscal impact.

Amending Section 2.21(1) of the Madison General Ordinances to allow additional reconsideration opportunities.

Body

DRAFTER’S ANALYSIS:    This ordinance permits an alder who was absent at the time of a vote on a matter, to move reconsideration of that item at the same meeting, as well as at the subsequent meeting which is currently permitted. This change treats alders who are absent for a portion of a meeting the same as alders who voted on the prevailing side for purposes of making a motion to reconsider.

The Common Council of the City of Madison do hereby ordain as follows:

 

                     1.                     Subsection (1) of Section 2.21 entitled “Reconsideration of Question” of the Madison General Ordinances is amended as follows:

 

“(1)                     It shall be in order for any member who voted in the affirmative on any question which was adopted, or for any member who voted in the negative when the number of affirmative votes was insufficient for adoption to move a reconsideration of such vote, at the same or next succeeding regular meeting of the Council. It shall be in order for any member who was, due to an excused absence, not present at the time the question was considered to move reconsideration of such vote at the same or at the next succeeding regular meeting of the Council. A motion to reconsider having been lost shall not be again in order. A motion to reconsider shall not be in order when the same result can be obtained by another motion.”
